(AP) — Jurors in New Mexico have awarded a man more than $412 million in a medical malpractice case that involved a men’s health clinic that operates in several states. The man’s attorneys celebrated Monday’s verdict, saying they are hopeful it will prevent other men from falling victim to a scheme that involved fraud and what they described as dangerous penile injections. They said the jury award for punitive and compensatory damages is likely the largest in history for a medical malpractice case. The award follows a trial held in Albuquerque earlier this month that centered on allegations outlined in a lawsuit filed by the man's attorneys in 2020. NuMale Medical Center and company officials were named as defendants. According to the complaint, the man was 66 when he visited the clinic in 2017 in search of treatment for fatigue and weight loss. The clinic is accused of misdiagnosing him and unnecessarily treating him with “invasive erectile dysfunction shots” that caused irreversible damage. “This out of state medical corporation set up a fraudulent scheme to make millions off of conning old men by scaring them with a fake test,” Nick Rowley, the man's attorney, wrote in a social media post that detailed the verdict. Rowley went on to say that the scheme involved clinic workers telling patients they would have irreversible damage if they didn't agree to injections three times a week. NuMale Medical Center President Brad Palubicki said in a statement issued Tuesday that the company is committed to high-quality and safe patient care. He said NuMale disagrees with the verdict and intend to pursue all available legal remedies, including an appeal. A message seeking additional comment was left Wednesday with the company and its attorney. NuMale also has clinics in Colorado, Florida, Illinois, Nevada, Nebraska, North Carolina and Wisconsin. According to court records, jurors found that fraudulent and negligent conduct by the defendants resulted in damages to the plaintiff. To contribute, click here . ••• Although America’s divisive presidential election is now behind us, casting votes did not do much to heal our country’s deep philosophical and political divides. We remain a polarized people, with about half the nation pleased about the electoral outcome and the other half perplexed by it. In a healthy democracy, there will always be vigorous debate and disagreement about what policy prescriptions are best for our cities, states and nation — and who is best equipped to lead them. A consensus is always hard to find in a country as geographically, racially and socioeconomically diverse as ours. But self-rule requires societal self-assessment. And an honest reflection on the worrying level of political enmity that exists today reveals we must do better for American democracy to thrive. The hostility on both sides of the aisle is not conducive to a free society functioning well, as it makes substantive discourse between disagreeing parties impossible and instills fear in many that exercising First Amendment rights will get them in trouble at home or at work. Democracy requires reflection, rigor and reason. It calls us to be calm, attentive and courteous. All things sorely lacking in recent ballot box contests. So how can this caustic political climate be reset? One potential simple solution: friendship. When we hold true friends who vote differently from the way we do, we can empathize with what motivates those on the other side of causes we care about. And that understanding allows for a more thoughtful approach to and investigation of our own views. By humanizing our public policy adversaries, politically diverse relationships help hold us back from using the cheapest and most destructive partisan tool: demonizing the opposition. My own anecdotal observations along with recent studies confirm that Americans are more and more segregating their relationships based on politics. An Axios poll of young adults revealed 33% of respondents would “definitely not” or “probably not” befriend someone who voted for a different presidential nominee. And according to a study by the Survey Center on American Life, 15% of people torpedoed acquaintances over political disagreements alone. It’s not hard to understand this troubling trend. Life can be a lot easier if one silos among people who see the world the same way. Let’s be honest: It’s gratifying to have our views affirmed and much harder to have them challenged. It’s effortless just to reject the political opposition as morally reprehensible and much more difficult to impersonally advocate one’s ideas with good argument and data instead. But failing to interact on a personal level with people we disagree with coarsens our politics, eliminates the philosophical and factual accountability that comes from respectful disagreement and makes us too strident with each other. Conservatives are a rare breed in my hometown of St. Paul, and if I chose my friendships based on partisan leanings I’d be a very lonely guy. But most of my best friends and neighbors here are dyed-in-the-wool Democrats. They are smart and well informed, and they deepen and enrich my own views by arguing their side of things with me. We listen to and learn from one another — and even though our minds are rarely changed, our opinions are refined for the better. But, more importantly, my left-of-center friends in the Saintly City are interesting, kind and of good character. How foolish it would be to cut such people out of my life simply because they vote differently. And I am grateful they keep me in theirs. While maintaining friendships across party lines sounds like a good idea in theory, it can be tough work. It requires of us a decision to love each other even in the face of disagreement and to honor our friends’ right to freedom of speech and thought. And while we can confront our friends’ views and preferred political candidates, we also must be willing to be the one who is challenged and to welcome such confrontation. A bipartisan friendship commands intellectual humility and leaves open the idea that we might be wrong. If one cannot do this and lacks friendships with significant political differences, it’s strong evidence one is an ideologue, which is not a good thing to be. Philosophically intolerant dogmatists have trouble getting along with those they conflict with on matters of political profundity. That type of intolerant attitude does not work well in a system of self-government that requires a free flow of ideas and discourse. And it’s an unhealthy and unhelpful characteristic to have if one wants to be productive and happy in a pluralistic society. “Everyone notionally understands his or her own fallibility,” the conservative Princeton Prof. Robert P. George, who enjoys a well-known and close friendship with Democratic Socialist Cornel West, wrote in a recent social media post. “But notionally isn’t enough. The test comes when someone disagrees with you about something you regard as profoundly important — when someone dissents from your deepest, most cherished, even identity-forming beliefs ... It takes genuine strength of character and courage — truly, and not merely notionally, to recognize our fallibility. Fellow truth-seekers can be friends because they recognize their own fallibility and are willing to be challenged, as well as to challenge. They’re eager to learn from each other. Unlike ideologues, they don’t allow infatuation with their own opinions to impede pursuit of truth.” Don’t we all want to be truth-seekers? Dogmatism seems like a downer. What daft advice. Our relationships with loved ones should always surmount politics, no matter what. And we can all help unite our fractured nation after this bruising election by committing to respectfully engage with those we disagree with and listen more earnestly to ideas we do not like. Loving those who think differently from us can also truly be one of life’s great treasures. Here's how it went and why the turducken is a surefire way to have your guests raving on Thanksgiving. My turducken showed up neatly packaged and completely frozen. What is a turducken? Look closely and you'll see a whole chicken, a duck and ample cajun stuffing inside this turkey. Turduckens are whole turkeys that have been deboned and stuffed with a whole chicken that has itself been stuffed with a deboned duck. The massive meat roll is roasted as one would a normal turkey, then sliced and served. One of the ideas is that the famously fat-rich duck helps keep the famously lean turkey from drying out. Turduckens landed in our lives mostly thanks to ex-NFL-coach-turned-announcer John Madden who would bust one out on live TV in his many Thanksgiving appearances. As the origin story goes , a turducken was sent up to Madden in the press box by a local New Orleans meat shop called Gourmet Butcher Block during a New Orleans Saints broadcast. Madden tried it, loved it and so incorporated it into his on-air turkey day tradition from then on. I remember seeing these trios of poultry stuffed inside one another like Russian nesting dolls on TV but always assumed the turducken was more of a stunt; a bit like a food meme before we even knew what memes were. I further assumed that, even if turduckens were any good, they were probably more trouble than they were worth to make, what with all the deboning, flattening, stuffing and seasoning. Not so with these ready-to-roast versions. The 12-pound turducken takes about 12 hours to defrost on the counter, and longer if you're planning to do it in the fridge. How do you cook a turducken, and how long does it take? First, you'll need to defrost the birds, which can take as much as three days in the fridge and more like six hours in a sink or bath of cold water. Cooking a turducken is rather simple but it does take time. The instructions directed me to cook the turducken at 375 degrees Fahrenheit for 4 hours covered and another hour uncovered to crisp the skin. I used a roasting rack with a pan underneath to catch drippings. I also used my Meater thermometer to track the internal temp, which must get to 165 degrees for poultry to be safely eaten. Note: Cook the Turducken longer than the instructions say I cheated and drizzled some melted butter over the skin about an hour before it came out of the oven. My turducken wasn't anywhere near 165 degrees after the prescribed five hours. In fact, it didn't hit that internal temp for another 90 minutes. Luckily, we had plenty of wine and appetizers to hold us over, but it's something to keep in mind if your turkey day runs on a tight schedule. If you order one, I would definitely weigh it (mine was a full pound heavier than it was advertised to be) and throw it in an hour or so earlier than you would normally, keeping a close eye on the temp. As a happy accident, the extra time in the oven helped get the skin to a perfect crispy brown, and there were lots of drippings in the pan for making gravy. I cheated a little and drizzled some melted butter over the skin about an hour before it came out of the oven, but I suspect it would have been plenty crispy on its own. How was it? So much flavored packed into this holiday bird. Pretty much everyone agreed it was about the tastiest Thanksgiving turkey experience we'd ever had. The fat from the duck permeated the entire roast, and all three meats were incredibly moist, tender and pumping with flavor. It was akin to eating pernil (roasted pork shoulder) or some other slow-cooked barbecue in the way everything sort of shredded and fell apart. When I sliced it, all three types of meat melted off the side and piled together with the duck fat, stuffing and seasoning blending to create a sauce. The particular turducken I ordered had a layer of Cajun cornbread stuffing and a bit of Cajun spice on the skin, too, so it had some kick; enough to notice but not overpowering. And nothing a bite of creamy mashed potatoes or sweet cranberry sauce couldn't neutralize. Where can you buy a turducken online? Goldbelly is your best bet for buying a turducken online. MONTREAL — Second Cup Canada is cutting ties with a franchisee operating at Montreal’s Jewish General Hospital who was allegedly filmed making hateful and antisemitic comments during a protest in the city last week. Second Cup Canada announced Saturday it was cutting ties with a franchisee for “making hateful remarks and gestures,” and adding in a statement the actions breach the franchise agreement as well as inclusion and community values ​​held by the chain. Peter Mammas, CEO of Montreal-based Foodtastic, which owns Second Cup Canada, said in an interview on Sunday that he was at the movies when his phone started pinging non-stop. He saw the videos and the company’s operations staff spoke to employees that knew the woman, and they confirmed it was indeed the franchisee. Video shot during a pro-Palestinian demonstration outside of Concordia University’s downtown Montreal campus Thursday shows a woman walking around, masked, saying the “final solution is coming your way” — wording used to describe a Nazi plan to eliminate Jews in Europe during the Second World War. Another video also shows what appears to be the same woman, unmasked, making a Nazi salute while walking away. “We’re all for free speech and respectful conversations, but this wasn’t that,” Mammas said. “This was hate speech, and it was something that we thought could incite violence and we’re completely against that, so we sat down with our team and decided to revoke the franchise agreement.” Attempts to reach the franchisee were unsuccessful on Sunday. “Second Cup has zero tolerance for hate speech,” the coffee chain said in a statement on X. “In co-ordination with the hospital, we’ve shut down the franchisee’s café and are terminating their franchise agreement.” Mammas said lawyers for the franchisee and Second Cup were expected to meet on Monday. The regional health agency serving West-Central Montreal, which includes the Jewish General Hospital, said it was made aware of the video “containing antisemitic and hateful messaging.” The video is related to a franchisee of Second Cup, one of the private tenants operating within the (Jewish General), Carl Thériault, a spokesman, said in a statement on Sunday. “We fully support Second Cup’s decision to take swift and decisive action in this matter by shutting down the franchisee’s cafés and terminating their lease agreement.” The hospital has two locations operated by the same franchisee and both were shuttered on Saturday by the owners of the chain. Optical storage media was a big consumer technology in the past as a method for digital content distribution but there was another market for optical storage for archival storage, where cartridges of optical discs were kept in libraries, similar to the optical libraries used for magnetic tape storage. These libraries used optical discs which were derived from Blu-ray and other mass market optical storage technologies and were often write-once optical media meant for archive applications. Let’s talk about where optical storage fits into the storage hierarchy and about the technologies being introduced by a number of optical storage startups, which could change the way that data centers store archived information. Data centers often use a combination of digital storage products with different performance versus cost trade-offs together to meet the needs of different workflows with the highest efficiency and lowest costs. The different layers in such a storage hierarchy today often feature solid state drives, SSDs, using NAND flash as a faster but more expensive, in $/TB, primary storage. This primary storage directly feeds the faster but even more expensive and volatile, DRAM memory used to directly support computation. There is another layer of digital storage, often called the secondary storage layer where lower cost, lower performance digital storage technologies are used to store a larger amount of less active data than that stored in primary storage. Secondary storage is where nearline hard disk drives, HDDs, are used the most to store data which has value, but which does not require the performance characteristics of most enterprise SSDs. In addition to HDDs there are a number of storage systems meant for secondary storage using quad-level cell, QLC, flash SSDs. These SSDs often higher storage capacity at lower cost than multi-level cell, MLC, and three-level cell, TLC, NAND flash, but they have lower endurance and lower performance, but still higher than that of individual HDDs. However, the raw storage costs of these QLC SSDs are still higher than that of nearline HDDs and so these products will likely have the most use where in-frequently written secondary storage with higher performance is needed. The final layer in this storage hierarchy is archival storage, where data is kept that still has potential value but which is very seldom accessed, for instance for various types of legal compliance or for historical value. This layer generally requires even lower costs for storage than the secondary storage layer and this is the realm where magnetic tape and optical disc storage have their greatest use. The chart below, from my colleague, Jim Handy, of Objective Analysis shows a log-log plot of storage performance versus capacity price for various memory and digital storage technologies. Coughlin Associates projects that annual storage capacity shipments for solid state drives (SSDs), hard disk drives (HDDs) and magnetic tape/optical storage should grow over 5X from 2024 through 2029. The majority of this stored data is for secondary or active archive applications where data is retained for later access and it is generally transferred to faster SSDs and DRAM for primary storage and immediate use. The percentage of data in secondary and archived storage is growing faster than primary storage. Optical storage libraries are still being sold as an alternative to magnetic tape storage and with the technologies being introduced by numerous startup optical storage startups, this use could increase. Coughlin Associates recently wrote a white paper on current archive storage technologies, including these newer optical storage technologies . This article includes some material from that white paper as well as the IEEE Mass Storage Roadmap . As secondary and archive storage demand grows, there may be opportunities for new storage media to play a role, particularly if they can provide higher performance, lower cost, including ongoing energy costs, and greater longevity than current archive storage media. There are also archival optical approaches that don’t use optical discs but rather ceramic coated rectangular glass sheets. Modern optical recording technologies are particularly interesting for archive and particularly digital preservation applications because the various optical storage media can last 100 years or more in a much less controlled environment that magnetic storage technologies. Conventional optical media uses lasers with a fixed wavelength to ablate regions of the media or to change the reflective characteristics of the media to create optical features that can be encoded to store digital information. This is how CDs, DVDs and Blu-ray discs work. Over 10 years ago, Panasonic and Sony created a roadmap for multiple layer two-sided Blu-ray derived optical storage that they projected would reach at least one TB per disc (Archival Disc, AD). In practice this technology, while used in some facilities, never became mainstream for general data archiving and demonstrated product disc storage capacity have not exceeded 500GB (their second-generation product, introduced in 2020. Sony and Panasonic both introduced optical disc library systems using their AD technology. There are many other optical recording media, which include PiqlFilm, which uses black and white, negative silver-halide film on a polyester base. This method is unique in that it can include recorded human readable instructions and file format and source code for reading data, in addition to digital data. This archive method is being used in some scientific, engineering and historical archives. PiqlFilm is also the initiator of the Arctic World Archive (AWA), a repository for world memory located in Northern Norway on the Arctic Ocean. Microsoft and the University of Southampton have explored volumetric archive recording in fused silica using a fast laser. This is a write once method with a media that should be stable for 100’s of years and can store up to 360TB of data on a 5-inch glass plate. The Southampton researchers have recently started a company, SPhontonix, to commercialize this technology. A California-based startup, Group 47 developed the Digital Optical Tape System (DOTS) that it says can preserve data for more than 200 years using a phase change media sputtered on a polyester-based film. The image below shows the SPhotonix optical storage concept. Various holographic optical recording technologies have also been developed over the years, but, although research on this technology continues, no commercial products using holographic recording have been successfully implemented for archival storage. Folio Photonics is a company which has developed a multilayer optical recording system for archiving applications which can result in photothermal recording similar to Blu-ray optical discs with either reflective or fluorescent recording technologies. Their technology uses photosensitive dyes dispersed in a polymer matrix to create a reflective or fluorescent optical media. This photosensitive material has a strong optical absorption at 405nm, the wavelength used for conventional Blu-ray discs. Using roll-to-roll co-extrusion processes, multiple layers can be produced all at once in a media which can be cut and placed on plastic optical disc substrates, reducing the costs of making a multiple layer optical media. Rather than using a spiral tracking feature embossed on conventional optical discs (hence the land and grooves), Folio does head tracking with a separate laser focused on the disc substrate where the tracking pattern is embossed. Folio Photonics believes that this could be done in multiple layers (dozens of layers all at once) with an initial manufacturing cost of less than $5/TB and with more layers going to less than $2/TB by 2029. Note that one of the on-going issues with multi-layer optical media has been the optical absorption of the layers which can reduce the storage capacity and signal from lower layers. The image below shows Folio Photonic’s projection for optical disc storage capacity with their technology. Another interesting optical recording contender is Cerabyte, founded in 2020 and with headquarters recently moved to Silicon Valley. Cerabyte uses sputtered 10nm ceramic layers on a glass substrate. Data is written encoded in an array of data matrices using a 2-D digital micro mirror with up to 2 million elements simultaneously written by femtosecond laser pulses in the UV spectrum with a write speed of 1GB/s and with less than 1W average power. Reading is done at GB/s data rates using high-speed image sensors and parallel high speed image processing for decoding. The image below shows Cerabytes digital recording concept. Both reading and writing are done across the square substrate by scanning the microscope optics using high-speed XY stages kept in focus using a piezo driven auto focus system enabling random data access. The 9X9 cm media sheets can be recorded on both sides and stacked in cartridges for robotic access similar to that used for conventional optical and magnetic tape libraries. Cerabyte projects media costs below $1/TB by 2030. Optera Data’s storage technology takes advantage of changes in the optical absorption/emission characteristics of its recording media at several adjacent laser frequencies during writing and then by reading these changes. These changes are referred to as spectral holes. They do this using an optical media which consists of a mixture of nano-particles with many particles lying within the write/read laser spot and the nano-particles have different but adjacent optical emission/absorption frequencies. To prevent oxidation, these nano-particles may be encapsulated in plastic beads and spread across a conventional plastic (or other material) optical disc substrate. The combination of these nano-particles, in which spectral sensitivities are close to and partly overlapping each other, results in a combined spectral emission profile that is called a “top-hat” fluorescence emission profile, that is, the light emitted by the different nano-particles, combine together to make a pattern like that shown in (a) in the figure below. With this media, tuning the write laser frequency to match that of one of the nano-particle frequencies creates a spectral hole where the nanoparticle emission can be diminished as shown in (b) in the figure below. These spectral holes can have a depth that depends upon the level of laser energy during the spectral hole writing as shown in the figure. Data can be encoded in both the frequency and depth of these spectral holes. Optera believes that, short term, 1TB discs are feasible with particulate media and medium term, a thin film single layer write once archival disc with high volume manufacturing costs of $1/10TB ($0.10/TB) is possible before the end of the decade. Longer term (say within a decade or so), these costs could be reduced even further, if this technology were implemented as a volumetric recording technology (perhaps even having 10X lower cost, $0.01/TB). Projections of new optical storage archiving systems promise 1PB optical cartridges by the 2030’s, compared to the possible 576TB cartridge projections for LTO Gen 14. Optical storage could be a significant contender for the digital archive market.WASHINGTON (AP) — President-elect Donald Trump on Thursday voiced his support for the dockworkers union before their contract expires next month at Eastern and Gulf Coast ports, saying that any further “automation” of the ports would harm workers. The incoming president posted on social media that he met Harold Daggett, the president of the International Longshoreman's Association, and Dennis Daggett, the union's executive vice president. “I’ve studied automation, and know just about everything there is to know about it,” Trump posted. “The amount of money saved is nowhere near the distress, hurt, and harm it causes for American Workers, in this case, our Longshoremen. They shouldn’t be looking for every last penny knowing how many families are hurt.” The International Longshoremen’s Association has until Jan. 15 to negotiate a new contract with the U.S. Maritime Alliance, which represents ports and shipping companies. At the heart of the dispute is whether ports can install automated gates, cranes and container-moving trucks that could make it faster to unload and load ships.
